Trimmer, Blower, Mower Contest Rules

98.1 THE MAX’S “TRIMMER, BLOWER, MOWER” CONTEST
OFFICIAL RULES
A complete copy of these rules can be obtained by contacting the offices of radio station WXMX (“98.1 the Max” or Station), owned and operated by Cumulus Radio LLC, 5629 Murray Ave. Memphis, TN 38119, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.
The Station will conduct the 98.1 the Max “Trimmer, Blower, Mower” Contest (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:

  1. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED. ALL FEDERAL, STATE, AND LOCAL REGULATIONS APPLY.
Eligibility. This Contest is open only to legal U.S. residents age eighteen (18) years [twenty-one (21) in Mississippi] or older at the time of entry with a valid Social Security number and who reside in the Station’s Designated Market Area (“DMA”) as defined by Nielsen Audio, who have not won a prize from the Station in the last 30 days or a prize valued at $500 or more in the last 90 days, and whose immediate family members or household members have not won a prize from the Station in the last 30 days or a prize valued at $500 or more in the last 90 days. Void where prohibited by law. Employees of Cumulus Radio LLC, its parent company, affiliates, related entities and subsidiaries, promotional sponsors, prize providers, advertising agencies, other radio stations serving the Station’s DMA, and the immediate family members and household members of all such employees are not eligible to participate. The term “immediate family members” includes spouses, parents and step-parents, siblings and step-siblings, and children and stepchildren. The term “household members” refers to people who share the same residence at least three (3) months out of the year. The Contest is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Station’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.
  2. Contest Period. The Contest will begin at 6:00am CT on June 6, 2022 and will run through 5:59pm -CT on June 17, 2022 (the “Contest Period”). The Station’s computer is the official time keeping device for this Contest.
  3. How to Enter. To enter:
    (i) On-Air: Listen to the Station, weekdays, on/around 7:00am CT, 11:00am CT and 4:00pm CT during the Contest Period. When the Station plays the “cue-to-call” sounder, listeners should call the Station at 901-203-9898. Caller nine (9) to the Station, as determined by the Station in its sole discretion, will be determined a qualifier and invited to the Grand Prize event (each a “Qualifier”). There will be up to (30) Qualifiers taken on-air in this contest. Time Delay Between Over-the-Air Analog Signal and Internet Broadcast: Due to the time delay that exists between the Station’s analog over-the-air signal and the Station’s online webcast, listeners who listen to the Station online may hear the cue to call later than listeners listening to the Station’s analog over-the-air signal. As a result, the odds of an online listener entering this Contest on-air may be diminished.
(ii) On-site: Visit Bartlett Small Engines (6780 Summer Ave. Bartlett, TN 38134) during normal business hours before Wednesday, June 15, 2022 and complete an entry form. Limit one (1) one-site entry per person. After 12:00pm CT on June 15, 2022, Station will collect on-site entries received during the Contest Period and select five (5) entries to be a Qualifier in a random drawing from all on-site entries received.
Listeners can only qualify once during the Contest Period regardless of the entry method.
  4. Winner Selection. On or about 10:30am CT on June 18, 2022, Station will hold the Grand Prize event at Bartlett Small Engines, located at 6780 Summer Ave, Memphis, TN 38134. MUST BE PRESENT TO WIN. All Qualifiers must bring a current, valid government issued photo ID and check-in with the Station no later than 10:30 a.m. CT. Failure to check-in and/or present current, valid government issued photo ID by 10:30am CT will lead to immediate disqualification and will no longer be eligible to win the Grand Prize.

Station will conduct a reverse drawing to determine the 5 finalists that will compete in the Grand Prize Game. Beginning at 10:30am CT, Station will randomly draw one (1) Qualifier’s name at a time until there are five (5) names remaining. These five (5) people will be determined the finalists (each a “Finalist”) and will compete in the Golf Ball Blowing Game.
Station will conduct a Golf Ball Blowing Game to determine the Grand Prize winner. Finalists will use a leaf blower to navigate five (5) golf balls through a wooden box maze and out of a mouse hole. The Finalist that completes this in the fastest amount of time will be determined the winner. Each individual will be timed by a Station employee and the time will be recorded. The Station’s timekeeper is the official clock for purposes of this Contest. Should a tie occur between any of the Finalist, then all Finalist’s names that have tied will be put in a hat and the Winner will be chosen via random drawing of all Finalists who got all five (5) golf balls out of the maze with the same time. Finalists will be invited outside, one (1) at a time, to compete and may not watch the competition before their determined turn.
Each Finalist will have ONE (1) opportunity for a practice run with the leaf blower before their official timed attempt.

UNDER NO CIRCUMSTANCES WILL A QUALIFIER BE ABLE TO HAVE A SUBSTITUION OR A PROXIE BEFORE OR DURING THE GRAND PRIZE EVENT PROCESS. QUALIFIERS MUST CHECK-IN AND REMAIN PRESENT THROUGHOUT THE DURATION OF THE GRAND PRIZE EVENT. FAILURE TO CHECK-IN BY 10:30AM CT AND/OR FAILURE TO PRESENT A CURRENT, VALID GOVERNMENT ISSUED PHOTO ID, WILL LEAD TO IMMEDIATE DISQUALIFICATION AND AT THAT TIME THE QUALIFIER WILL NO LONGER BE ELIGIBLE TO WIN THE GRAND PRIZE.
The winner will be notified at the Grand Prize Event and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these rules). Station’s decisions as to the administration and operation of the Contest and the selection of the potential winner are final and binding in all matters related to the Contest. Failure to claim the Grand Prize within thirty (30) days of winning result in disqualification and forfeiture of the Grand Prize.
Sponsor makes no representation or warranty about the safety of the Grand Prize Event in light of COVID-19. Any public location where people are present provides an inherent risk of exposure to COVID-19, and Sponsor cannot guarantee that any person will not be exposed during the Grand Prize Event. By attending the Grand Prize Event, participants acknowledge the risk of large group gatherings and assume all risks of attending the Grand Prize Event.

  1. Verification of Potential Winner. THE ELIGIBILITY OF ALL POTENTIAL CONTEST WINNERS IS SUBJECT TO VERIFICATION BY STATION WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. The potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner may be notified by email and/or telephone call after the date of random drawing and/or winner determination. The potential winner will be required to sign and return to Station, within three (3) days of the date notice is sent, an affidavit of eligibility and a liability/publicity release (except where prohibited) in order to claim his/her prize, if applicable. A winner who returns the affidavit of eligibility and liability/publicity release will be deemed to have accepted the contest prize and thereafter will not be permitted to rescind their acceptance of the prize and/or return the prize. If a potential winner cannot be contacted, fails to sign and return the affidavit of eligibility and/or the liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. In the event that the potential winner of a prize is disqualified for any reason, Station may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.
  2. Grand Prize. Up to 1 (one) grand prize will be awarded in this Contest. Each winner will receive:
    (a) a Trimmer, Blower and Lawn Mower from Bartlett Small Engines

The approximate retail value (“ARV”) of the grand prize is Nine Hundred Dollars ($900)

Winner is responsible for all taxes associated with prize receipt and/or use. Odds of winning a prize depend on a number of factors including the number of eligible entries received during the Contest Period and listeners participating at any given time.
There is no substitution, transfer, or cash equivalent for prizes, except that the Station may, in its sole discretion and to the extent permitted by law, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Any tickets and/or gift certificates/cards awarded as part of a prize will be subject to the terms and conditions set forth by the issuer and are valid only on the date(s) printed on the tickets or gift certificates/cards. Other restrictions may apply.

If any prize or a portion of any prize is postponed, cancelled, or otherwise unavailable due to disease, epidemic, pandemic, quarantine, any acts of government and/or any reason that is beyond the control of Station or any Sponsor, then no substitution shall be provided.
